@Cameron Rentch I spoke with Brett this morning at Saddle Rock and while he said they are excited about the future with us they simply cannot do a deal without the insurance part in the MSA. I even explained that this is just an early test and lets try this first. If it turns into more and we end up doing a lot of business together but he is adamant. Here is what he sent us…

Hey guys, just to recap our conversation this morning, the insurance clause is there to protect both of us in the event that things go sideways. We have this signed with every vendor regardless of structure. As I mentioned, the only red line we’ve allowed here is dropping from $3mm to $1mm. Also, it makes sense to start the relationship with governance that will last from small to large budgets. Let me know your thoughts.

He confirmed for me that this is the last sticking point so if we can agree to this we can move forward if not then they are forced to pass.

@Craig Smith this is a problem. Due to TCPA regulations our legal counsel has expressly stated we are to not use any "pre-recorded messages". Even though this may seem compliant it would be very easy for a claimant to actually file a TCPA claim. Additionally, this will cause a big delay in the time and process to secure the claimant and could result in loss of conversion and/or increased costs. I would recommend that we do the following to wrap up: "Lastly, to enhance your understanding of the paperwork, I'll connect you to a brief 2-minute recording by one of the Attorneys, Tom Young. Landing Page Edits:

  1. There isn't a $10 Billion settlement. please edit
  2. Juries are consistently considering compensation claims reaching millions of dollars. Wouldn't say "consistently". Maybe "Juries have awarded several clients millions of dollars."
  3. Those that qualify will have an individual claim filed in a court of law for the justice and compensation they deserve. I would say "may have an individual claim filed..."

  1. Would you need any more info from the client around targeting (facilities, states, criteria, etc.)?
  2. Based on previous nursing home campaigns, what you expect the cost per signed retainer to be on the high side. I know it will be a test, but wanted to give him a general idea.
  3. Could he start with us at $50k spend instead of $100k? He'll spend unlimited if it goes well. Last year his firm did 350 cases and would be happy to double that if the market permits. So you know, their firm currently pays Morgan and Morgan and other firms referral fees, so getting cases directly is a priority. Their average case value is $240k. 40% attorneys fees comes to $96k per. $24k of that goes to Morgan and Morgan (25% fee on back end).

I explained that we woild do our very best to keep the cost down, but the tighter criteria makes the price go up. To keep going, he’s asking us to cap the costs at $5,000 for this initial campaign (and to send any cases at lower costs if possible). He tells me other vendors are still at $4,000-$4,500. I DID reiterate our quality and QA process and he understands that.

@Craig Smith yeah exactly why I was super hesitant. I believe it is really really picked over, and that most centers are signing up alot of dual reps. We caught 5 of the claimaints attempting to lie during intake to eventually admit they had signed up with a lawyer but the lawyers havent called them in years. Please remember, we do not do refunds. Please ensure you make this a verbal and written point in your discussions with people. We can always shift the funds to something else. However, with them, I am fine with refunding it. We will give it another 4-5 days to see how the remaining leads we have generated pan out. Please bump your call to next week, after Tuesday.

MDL Judge David Campbell (Arizona): Judge Campbell oversaw a substantially similar MDL (Bard IVC filter) and appears to have a good grasp of what to do with these cases. It’s notable that Judge Campbell oversaw a $3.6MM verdict in the IVC cases that facilitated settlements. His comments and orders so far seem to indicate that he knows what he’s doing and knows how to get us to the finish line. More on that below.

BW Pool Closed: There are 150 cases pending in the MDL. Judge Campbell closed the BW pool, picked 24 cases for workup, and will schedule 6 BW trials for late 2025 through September 2026. He has made clear to leadership that the cases are either settled or remanded by the close of BW trials in September 2026.

SOLs and New Cases: From a pragmatic perspective, because Judge Campbell has already closed the BW pool and essentially told the parties that there won’t ever be another BW pool, Leadership and I agree that it is unlikely that cases that are filed now will face strict SOL scrutiny by defendants. My opinion is that this will give SHC more flexibility to keep new intakes/referrals and avoid rejecting/declining clients based on expired SOLs.

Would love to find a way to make this work.   We received pricing, and are moving forward, with vendors pricing PFAS campaigns in the $1,900-$2,100 range. At this CPC, these vendors would need to reach 70%+ fallout to hit the net cost per case that Shield is charging gross (with 0% fallout). We understand Shield’s quality will likely outpace the other vendors’, but their value would need to be significantly higher to breakeven.   Is there a way to modify the mix of injuries and/or % of CMO6 to derive a lower CPC?   1. we utilize a system called "Dentity" (seen here: https://www.dentity.com/). We do verify the ID using their platform, but we do NOT store the PII intentionally. We can create the firm it's own link/account where they can API the PII (copy of DL directly to their system, we do not have anywhere to securely store this). There is a nominal fee for each of these, but we cn do this during the QA process, prior to secondary interview.
  2. Our policy is to ASK for the SSN. Many claimants get nervous about providing during initial call, so we explain that we require at least the last 4 to ensure we can verify their identity when the law firm calls them. We typically collect this on the intake, not the HIPPA.

Re Saddlerock, we’ve never taken 5/6, and I think they are not looking at the CMO 28 from the MDL so suggest we don’t take those. Therefore they are taking a the 6 cmo diagnoses + prostate under 55.

@Craig Smith We have run this campaign before (approx 2 years ago). We did well but it is important to note that our experience shows that a good portion of the claimants were ultimately DQ'ed/rejected due to lack of credibility, being intoxicated/under the influence, and/or having prior criminal records that result in the firm rejecting the cases. We do our absolute best to mitigate these issues but it is something to be aware of.

Our estimated acquisition cost on these is 5000-6000/per, but we really need to test 100K. This is due to limited SOL's and a tight "cut off" in the 2 year states, which represent the majority of the state SOL's. I would NOT recommend doing this campaign as I think 1) there are far better opportunities and 2) it is likely to not be very successful and may leave a bad taste in their mouth

@Craig Smith I actually just had a firm contact me about this as well. This was my reply:

I believe we spoke about this last week and I told you I would look into it. Bottomline is the the Uber/Lyt are very difficult and not a campaign I recommend. We are able to get a lot of inquiries but they fall out, or have spoken with a lot of other attorneys or are flat out lying. Look I would l love to have you working more campaigns with us, and I know if you call around someone WILL take your money on it, but I would be very cautious. I do NOT think it will work.

I believe I told you about the Chowchilla cases that I think you should go after in Northern California right away. Here is the quick 411 on these cases. They are essentially the same fact pattern and issues that we just did in the Dublin prison cases in Northern California as well. They just settled 140 of those cases for $140M.

Chowchilla was originally challenged under government immunity but the has been overcome. They are essentially in a position of looking to settle now. I am happy to get you more info on that.

I would also be willing to get use some pricing for Uber but I strongly recommended against paying us for it.

Lastly, we are essentially done on your VGA so please let me know about continuing that today if you can.

Torticity's tech person (Matthew) just replied on the issue. An outage on his end due to inclement weather that was the cause in lack of response. Ahsan is working on the next test send that should go out in 1-2hrs. I requested a call and additional contact info from their team to try and get the existing lead/docs over to them today. I'll keep everyone posted. ---- Also, a response came in this morning (7 day lag) to help us move forward with PFAS and get data/docs to their CRM, allowing Bridge Legal to see it directly. I'll continue to try and get a conversation going with them to see this through.

Yes. We just like to have the backup files (questionnaire, intake docs, etc.) to supplement the data that was sent over API. Feel free to share a data room or similar.

Comments for any improvements in a future campaign (either on PFAS or other) We still have a very strong flow coming in on PFAS and AFFF. As discussed with Evan, and per recent ELG updates, a next round could include tighter criteria. Focus on Category A injuries but keep B and C categories open for any military.

Sounds great. Once we assess the quality of the first cases, we will revert on a future campaign.

Torticity • test lead was sent 8/12 ◦ lead was received successfully ▪︎ feedback and additional requests include: label change for the retainer; change of 'externalLeadSourceId' to 'externalId'; request for 2 more test leads once adjustments are made ▪︎ Torticity acknowledges that there will be a lag between the lead creation and the docs being sent; this is a know lag on their end • happening 8/15 ◦ adjustments are being made to MPA flow following their feedback ◦ 2 test leads will be sent ◦ assuming that there will not be more feedback or requests, the client can approve this to go into production (we can move this to production in a matter of minutes for Torticity) Bay Point • test leads can be sent as soon as the Torticity tests are successful and we are approved to go into production ◦ that pre-requisite is there because the entire MPA flow has to be cloned and altered to fit Bay Point ▪︎ this can also be done today, assuming the Torticity test is successful • there is a chance of feedback and/or additional requests, but we won't know until the Torticity baseline is complete and the Bay Point test is sent

Torticity delays initially were on them, their staff was out of office and then were affected by storms in houston. We have been in back forth. The errors showing erqure feedback from them. We have gone as far as we can and are waiting for results of errors, once we get this resolved and approved it is ready to be live.

Bridge - they admitted it is on them, not us. They actually sent a message apologizing for delays. They sent us an intake form that we arent even using and the campaign is already done, so we are replying to them to make sure they are aware A) campaign is done B)we are using our intake that Baypoint already approved.

They have two questions they are using for this: “Did the PNC have a Bard PowerPort or AngioDynamics implanted?” - They are answering this question as a Y/N question (not specifying which brand), or most they are answering as “Unsure between Bard PowerPort and Angio Dynamics” as if the person knows they have one of these two brands but not sure which one, which seems odd that so many people would answer that way. They have a follow-up question “Which model of catheter was used on the injured party?” this sometimes will include the brand, but again there are times they say Y to the first question “Did the PNC have a Bard PowerPort or AngioDynamics implanted?” and then Unsure to the next question “Which model of catheter was used on the injured party?” Our plan is to mark as unsure unless they list the brand in one of these questions, but it seems odd so many people would say “I don’t know what I have but I know it’s one of those two brands.” It would be preferred if they would answer the question as Bard PowerPort, AngioDynamics, Unsure, or None of these We’re having issues with some of the diagnosis questions: One of their questions is, “Did the implant port system…:” and answers are: i. “Leak” ii. “Cause blood clots, infection, or a pulmonary embolism” – it’s not clear which of these things happened since all 3 are included in the answer There is another question, “Was the injured party diagnosed with…” it seems like there is a list to pick from, but when there is more than one on the list, the answer that comes through is, “2 or more of the diagnoses” not saying what any of the diagnoses are. We are having issues knowing the dates. There are three questions for the diagnosis dates, but it’s not clear which complication any of the dates correspond to: i. “On what date did the complication(s) occur?” ii. “Additional complication date:” iii. “Additional complication date:”

—- Here’s a few more we wanted to bring to your attention for the signed cases coming in from Shield that we are having issues qualifying:

04489575/ 31167 – This one came in saying Yes to “Has the injured party signed any documents with another law firm about this matter.” It also said No to “Is the injured party currently represented by an attorney for this matter.” So not sure if one is incorrect or if the person had an attorney and dismissed them. We are seeing a number of ones come through where the person has a qualifying issue (in this example “leak”) but the surgery questions are left blank. We don’t know if the questions aren’t being asked or if the answer is NO to surgery. If the person did not have a surgery and the claim will not qualify if “Fracture”, “Leak”, “Migrate” was the only injury. Here is an example: <image002.png>

There is another treatment question further down which is sometimes mentions surgery but sometimes not: <image003.png> 04492969 / 31217 – This is the intake from above, it says the device leaked but no indication of a surgery and they didn’t have any of the other qualifying injuries (blood clots, infection, or pulmonary embolism), so seems like it would not qualify. 04491087 / 31187 – This is another example; it says the device leaked but no indication of a surgery. They also had infection & blood clots, but with no indication of a surgery or other issues this would not qualify. We have other examples where the surgery questions are blank but we were able to qualify off of another field or injury, but it still would be helpful to know how these questions are being answered.

Note, we still are implementing a verbal consent with the claimant and will be having each claimant sign a separate consent form for each law firm that will be provided within the retainer packet. We have done a very deep dive with our compliance counsel and are very ahead of all regulations that impact our business

Targeting focus is Eaton fire, but all other fires are accepted with residential property or commercial property damage,

For Eaton, no insurance is required. Other fires required Insurance.

For Eaton, personal property loss of any type (ie renters, vehicles, personal property minimum of 25k loss).

For Eaton, any injury accepted with hospital visit and treatment.

For Eaton, running from fire fearing for life accepted.

Currently 3-4k avg cost per. No guarantees on rates and market price based on fluid situation and evolving criteria.
