Our other firefighting foams make it clear that they need to have significant number exposures that the client can describe and no PFAS/TOG questions. The questions they have on their form kind of have the client break them up into more detail but no kind of actual qualifiers/criteria for the agents to follow correctly. It's hard for me to really explain lol
That's ok, basically their AFFF has PFAS as well and we treat that differently and will take extra time to setup if they want to use the PFAS part

If PC born after 7/24/1983, SOL is good. But we’re signing cases where SOL gone as well, and will try to work tolling theory. Where abuse occurred, nature of abuse, whether a known perp, etc. are all also relevant to value, but that’s not part of criteria at initial signing stage. Best cases are those involving Archdiocese of Chicago, Diocese of Joliet, and religious orders in the Chicagoland / Cook County, Will County, and Lake County areas… and a known perp.

Unknown perpetrator and location are still okay, but the case won’t be as strong." So what are we supposed to put on the retainer if the PNC does not know the Location.

So Time Barred refers to the Statute of Limitations. Let's say we have a claimant in Arizona who was abused 5 years ago but their SOL is 3 years. Usually we'd disqualify them but Dicello is going to take them for review. We have a script to say in that instance.
Cases that fall into the statute of limitations are totally fine. but the ones outside of it will need the special spiel and we'll put them under the NON-SOL status

Delayed discovery rule is a little different. It basically lets them suspend the SOL but it would be based on when something started. Like the thing that led to discovering there was an issue. So if you have surgery and they leave a sponge inside. You won't know right away. Years go by and you start hurting only to find an old dirty sponge inside.
The 4 year assertion is basically saying that.... You have pain from the sponge and you know it's the sponge.... you have to 4 years from your assertion of the claim to file.
He kind of explains the 4 year thing here: -revision/removal/recommendation for revision/removal must be within 4 years of the claimant asserting the claim (Ie at the time they are bringing the claim during Intake)
So if i'm calling in, a doc should have told me within the last 4 years to take the sucker out
So the SOL guide that the firms sent does a really good job at stating the Rule of Accrual for product liability
CA is vague as heck tho. let me find the opinion
"We conclude that, under the delayed discovery rule, a cause of action accrues and the statute of limitations begins to run when the plaintiff has reason to suspect an injury and some wrongful cause, unless the plaintiff pleads and proves that a reasonable investigation at that time would not have revealed a factual basis for that particular cause of action. like if she got it implanted and the doctor said nothing and suddenly today she's really sick and another doctor says why, yeah she'd qualify under delayed discovery but i'd send it for a firm review
she technically had 2 years based on SOL in CA because the Doctor called it out in 2017
and no rule of accrual because the doctor warned her
it's awful. TBH i remember warnings about TVM a few years ago
the 4 year assertion thing is kind of a good rule to start with. For the most part, the clock starts ticking when they find out there is a problem

I just received a message from SGGH regarding their IL YRTC campaign. They have updated criteria.
Please see below for updated criteria regarding acceptable IL YRTC sexual abuse cases: We are only signing cases that involve: • Oral sex • Any form of penetration (digital, vaginal, rectal) • Fondling under the clothing • Incidents where staff forced a minor to engage in sexual acts with another (including both staff-on-patient and patient-on-patient abuse facilitated by staff) Do not sign cases that involve only over-the-clothes groping or fondling, unless the conduct was uniquely excessive or outrageous and occurred on a regular basis. Additionally, please gather more detailed information regarding: • The identity and role of the perpetrator (e.g., therapist, guard, night aide) • The nature of their relationship to the victim

Inmate on inmate goes in osol it looks like based on what cam sent. We do need to make sure that we are tracking that

If they don't know the brand but know details like it was surgically implanted under the skin and it wasn't a urinary catheter, that's fine. Basically if they aren't sure but all the other criteria is met

That AND is very important here. At this point, they probably know the abusers. So if you say "Jimmy. he's a creepy little white guy with brown hair and one eye" they'll know.
