BULLOCK WARD MASON HAIR RELAXER CRITERIA
General criteria: Must be able to identify products used (hair relaxers only) Must be able to recall start and stop date (if they have stopped) Must have used relaxers consistently (6-8 weeks on average) for a minimum of five years (greater than 4 applications per year) If a death case – must have a strong corroborating witness regarding product usage
Injuries/Diagnosis: (Diagnosis dates in 2010 or later, before age 45) • Uterine/Endometrial/Ovarian Cancer o If Ovarian Cancer – screen for talc usage • Fibroids o Must have had surgical intervention (myomectomy/hysterectomy/uterine fibroid embolization) o Ablation only does not qualify • Endometriosis o Must have had a hysterectomy
Ideal plaintiff: • Diagnosed with any of the above conditions b/w ages 20-45 • First introduced to Hair Relaxers prior to age 12 • Experienced menarche prior to age 12 Additional Damages – Must meet all the requirements above • Infertility as a result of any of the above pelvic conditions • Miscarriages as a result of any of the above pelvic conditions • Blood transfusions due to anemia caused by excessive bleeding (fibroids/endometriosis) • Preterm labor/delivery (w/underlying fibroids or endometriosis) • Early menarche/puberty • PCOS • Chronic thyroid or hormonal imbalances

I'm sure he has told you about Susan Barfield at Case Works and how we are under an NDA with her. She is asking for pricing on several torts so she can bundle packages to include the case work up process her company provides. She is very new to the acquisition part of the business, so she's asking a lot of questions and Andy and I are slowly trying to educate her.
Her goal is to get pricing for the following: RoundUp, AFFF, Hair Relaxer, NEC, Sex Abuse, Suboxone and Bard PowerPort.
Can you please provide me with price ranges for each so I can work with her to put together a bundled package to present to the funder? Once she gets this approved with one law firm, she plans to duplicate it with others.
She may even need our help with co-counsel as a lot of the firms that will participate in this program will be passive investors looking for a diverse tort mix.

Client has exclusivity with these wildfire claims and first right of refusal. Shield Legal follows ABA guidelines for rules of lawyer advertising. Client is responsible for compliance with local rules and regulations for lawyer advertising.

Lived on or near a known Military base with contaminated water (high levels of PFAS) OR Used known contaminated water with high levels of PFAS (residential, well, etc) OR Willing to undergo blood test for high levels of PFAS
Diagnosed within last 20 years OR had exposure after 1960 and were diagnosed within 20 years
Additionally, very long latencies of 40+ years or more since last known exposure to AFFF/PFAS are only acceptable for Kidney Cancer and Testicular Cancer IF they have a minimum of 10 exposures.

Category A Injuries - most highly linked
Kidney Cancer 15 years, but can be less for aggressive cancer types

@Patsy Miller it is going to be really expensive if those are the only accepted case types. ELG is taking all of the type of cases referenced in my original slack. My guess is that Kevin is taking these to only get the "TIER 1" injuries, which of course everyone wants but there is still value in the other case types. We are not currently running a "selective" cancer campaign. Let's see if we can find a way to help him see the value in taking all of the case types.

@Andy Rogers @Cameron Rentch I had a conversation with Ron Makarem today. He is not my client, but I’m stepping in to help because he is very frustrated. He has heard all sorts of conflicting information about AFFF, from vendors he met at MTMP.
He found a vendor that will provide him with a similar acquisition cost but exclude Prostate cancer…since he’s hearing there’s no value there.
I explained to him that we will never be the cheapest, but our quality is better than I’ve ever seen in all my years in this space. He seemed to think “quality” meant we were only signing high value cases so I spent time explaining fallout rates and compensable cases. Unfortunately, I was too late in my efforts as he has already signed up with another vendor.
While I expect law firms to diversify, I’m always skeptical when a vendor has convinced a mass tort newbie that he should invest in an altered criteria at a low cost. I’m sure you both agree. I explained that a low cost with a 35-50% fallout means he has essentially doubled his acquisition cost.
Ron wants to stop his AFFF campaign as soon as possible. He thought it was stopped last week when he still had $80k remaining. His Monday report apparently showed he is now at $30k. He wants either a refund or the opportunity to move that balance to IL Juvenile. (Which he says Greg was supposed to help him with months ago.) Can we make that happen?
He also mentioned that he wants to diversify with other litigating firms. He’s already scheduled to speak to Cade and is being introduced to Motley Rice. He didn’t exactly say he was not happy with BG, but it seems he is disappointed in delayed responses he’s getting from Jon. (It seems like other vendors are introducing him to other firms, unless we made the Cade intro and I’m just not aware of that.)
Lastly, I want to be clear I am only trying to help with this client. I am not trying to take commissions from another sales person. This is the second conversation I’ve had with Ron where he expressed concern that Greg can never help him, is not able to answer questions, and makes failed attempts to connect him with the appropriate people. He explained that he doesn’t even understand why Greg is his account manager. Greg even called him while we were talking and he said he never even wants to answer his calls.
He explained that when he first decided to get into mass torts he called the number in his phone for Walker and didn’t know it was Greg’s cell number. He said he was instantly passed to Andy and Greg has never been helpful.
In an effort to keep this client in a positive space, I am happy to help.
I need to get back to him with his final balance and whether we can move it to IL Juvenile or refund him.

Ron would like that reflected on the invoice, rather than the invoice he got that simply reads $70k. Diagnosis by biopsy of lung cancer or AML within last 3 years
Employed directly for railroad for 10 years or more prior to 1990.
Best exposure is working inside the roundhouse but riding the rails and laying track work too.
Deceased cases must have names of living RR coworkers who worked with Deceased at the RR
Mesothelioma sign up any you see with diagnosis or death in last 3 years.
No colon cancer or throat cancer or asbestosis
Exposure in continental US.
Be wary of people with prior lawsuits against RR for personal injury. Lots of very broad waivers out there.
They are also interested in Maritime lung cancer/AML claims with exactly the same criteria but must have worked on a container ship.
What test budget should I request? $25k for each? Also, would you run this as two separate campaigns? @Cameron Rentch

They basically said they don't want to redo the ads. They provided content for us to use as needed. It's our marketing campaigns and they don't want to get involved with CTAs and content requirements. They are trusting you to create a successful campaign. They just wanted to make sure the dates and locations were accurate. Once they get your revisions they will present them to the firms and get them approved.

@Patsy Miller for Nursing home campaigns we really need to focus in on specific facilities that have known abuse that we can reference and target the facilities directly. "general" nursing home campaign do not perform well and typically we steer clear of them on a state x state basis. If they can provide us with the specific names of the facilities we can look at this. 50-100K testing budget would be best.
On Cumberland we are getting leads, but have not seen any claimants that would qualify under any of the above paramaters. The team is aware of all above and criteria is confirmed.

Last week the Senate held a hearing and dropped this bombshell report on Residential Treatment Facilities (RTFs) which includes some BB clients and has multiple references to Universal Health Services/Cumberland. Maybe you can somehow piggyback off this information.
Here are a few quotes from the report that might be of interest: Public reporting of sexual abuse at multiple UHS facilities shows instances of staff initiating– and sustaining– sexual contact with children post-discharge. At Cumberland Children’s Hospital (UHS; Virginia), a psychotherapist, was charged and indicted on “two counts of object sexual penetration by force.”
A staffer at Cumberland Hospital (UHS; Virginia) poured hot water on a child, leading to second-and third-degree burns. A Cumberland Hospital (UHS; Virginia) staffer, who pled no contest, was sentenced to one year in jail for a felony wounding charge based on evidence of a 2019 incident in which she “pour[ed] scalding water on” a non-verbal 16-year-old with developmental disabilities because she had struggled to get him to sleep.

@Cameron Rentch I'm in the process of closing Vogelzang on an Asbestos test campaign with a test budget of $100k. I have explained to him that we will need to discuss renewal while the campaign is still active...at about 60%. He is asking me how long it will take to reach 60%. Can you please give me an idea of how quickly we will blow through his budget so I can set his expectations appropriately?

@Patsy Miller @Andy Rogers we have not run this campaign in over a year. Will need to retest but decent criteria. Target/estimated range for criteria is 1000-1300/per. Likely will be lower but until tested we won’t know.

In my discussion with AWD ceo last week, said they are getting a slow trickle, 20-25% fallout averaging 6k per. Should make everyone "nervous" that people are asking which means they arent getting any good quality or volume right now.
@here Just to be clear, have we ever run a Rideshare campaign? Majed keeps asking questions I can't answer. If we ran in the past, what was the acquisition cost? Any idea what the fallout rate was...and what the cost would have been after fallout?
yes @Patsy Miller we have - the prior numbers are not really relevant as it was over a year ago. the figures above are likely reasonable, dependent on specific criteria. Personally, I wouldn't let anyone I know spend $ there without a clear disclaimer - likely not going to be very good, no refunds, likley move funds to another campaign. Again, I have heard challenging things about Nachawati firm.

They will need integration...but will launch with email delivery of retainers and backfill via API when it's ready. @Patsy Miller this is helpful however, Intake will have a real challenge using this for implementation. Can you ask for a guideline that is more simplified. Since we are talking with parents and not children, we really need to know what the CAP should be of the age of the child at time of sign up. We need a hard number and cant rely on people to perform calculations. I hope this makes sense but we can not have Intake making sol related decisions. Thank you

@Cameron Rentch Morning. Is there a "date of first exposure" requirement for Asbestos? I've seen firms ask "Were you exposed to asbestos BEFORE December 31, 1982?". Do we ask something like that? I'm trying to close a deal and they asked about this.
No there is not. It’s very straightforward criteria. We ran for over 2 years with BG and it has never been an issue whatsoever.
@here I just had a call with the Bieber Firm and they are very happy with the volume and case quality so far. They didn't expect the results to come so fast. There is one that didn't meet criteria and she will be forwarding it shortly. I'm trying to get a renewal before budget is depleted...but a larger budget.

Some will count toward first budget, some are overage toward next. The moving forward rate I provided doesn’t change. We have to be prepped and plan. As mentioned, likely can be lower but if they need a number as placeholder that is valid.

As I mentioned prior, the next round ranges will be 1650-1800/per (please note that this likely may get even lower for a time period but WILL increase as we get into October).

Note we are still signing contracts and charging as we move forward so we will allocate anything over 50K toward the next campaign.
